Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Bunkalist mobile application (the "App") or visiting this website, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not use the App or this website. Continued use of the App following any changes to these Terms constitutes your acceptance of the updated Terms.

Bunkalist is a personal project developed and operated by Naim Dridi Podadera as an individual developer. This is not a commercial entity or registered company. These Terms constitute the entire agreement between you and Naim Dridi Podadera regarding your use of the App.

2. Description of Service

Bunkalist is an entertainment tracking application that allows users to:

• Track movies, series, and anime across personalised watchlists (e.g., Watching, Completed, Plan to Watch, Dropped).
• Rate and review content.
• Create and share custom ranked "Tops" lists.
• Discover content via the Explorer and Scroller features.
• Track episode progress for series and anime.
• Access premium features via an optional subscription.

Content metadata (titles, posters, descriptions, cast information, etc.) is sourced from The Movie Database (TMDB). Bunkalist is not endorsed or certified by TMDB. This product uses the TMDB API but is not endorsed or certified by TMDB.

We reserve the right to modify, suspend, or discontinue the App or any feature at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

3. Eligibility

You must be at least 13 years of age (or the minimum digital consent age in your jurisdiction) to use Bunkalist. By using the App, you represent and warrant that you meet this age requirement.

If you are located in the European Union or European Economic Area, you must be at least 16 years old, or have obtained verifiable parental or guardian consent, to use the App.

Parents and guardians are responsible for monitoring and supervising their minor children's use of the App. If you become aware that a minor is using the App without appropriate consent, please contact us at bunkalist@gmail.com.

4. Accounts & Registration

4.1 Account Creation

You may use Bunkalist as a guest (anonymous user) or create an account by signing in with Google or Sign in with Apple (iOS only). You may also register with an email address and password.

By creating an account, you agree to provide accurate and complete information. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

4.2 Account Security

You must not share your account credentials with any other person. If you suspect unauthorised access to your account, you must notify us immediately at bunkalist@gmail.com and change your credentials via your sign-in provider (Google or Apple).

We are not responsible for any loss or damage arising from your failure to maintain the security of your account.

4.3 Account Deletion

You may delete your account at any time from within the App via Settings → Account → Delete Account. Upon deletion, your account data (profile, watchlists, ratings, tops) will be permanently erased from our servers within 30 days. Some data (e.g., anonymous crash reports) may be retained as described in our Privacy Policy.

4.4 Anonymous Use

Guest (anonymous) users may access core features of the App. Anonymous data is tied to your device installation. If you uninstall the App without linking your account to Google or Apple, your anonymous data cannot be recovered.

5. User Content

5.1 Your Content

Bunkalist allows you to create and store content, including watchlist entries, ratings, text reviews, and Tops lists ("User Content"). You retain full ownership of your User Content.

5.2 Licence to Us

By submitting User Content to the App, you grant Naim Dridi Podadera a limited, non-exclusive, royalty-free, worldwide licence to store, display, and transmit your User Content solely for the purpose of operating and providing the App's features (e.g., syncing your lists across your devices, displaying your public Tops lists to other users if you choose to make them public).

This licence does not extend to any commercial use, redistribution, or modification of your content beyond what is necessary to provide the service.

5.3 Public Content

If you choose to make your profile or Tops lists public in Settings, other users of the App may be able to view that content. You are solely responsible for any User Content you choose to make public. You can revert your profile to private at any time in Settings → Privacy & Data.

5.4 Content Standards

You agree that your User Content will not:

• Be unlawful, defamatory, harassing, abusive, or obscene.
• Infringe any third party's intellectual property, privacy, or other rights.
• Contain spam, advertising, or unsolicited commercial content.
• Impersonate any person or entity or misrepresent your affiliation.
• Contain malicious code, viruses, or harmful content.

We reserve the right to remove any User Content that violates these standards, without notice, at our sole discretion.

6. Acceptable Use

You agree to use Bunkalist only for lawful purposes and in accordance with these Terms. You must not:

• Use the App in any way that violates applicable local, national, or international laws or regulations.
• Attempt to gain unauthorised access to any part of the App, its servers, or any systems connected to the App.
• Use automated tools, bots, scrapers, or scripts to access, extract, or interact with the App or its data.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Interfere with or disrupt the integrity or performance of the App or any third-party services used by the App.
• Create multiple accounts for the purpose of abusing the service or circumventing account restrictions.
• Use the App to transmit or distribute malware, viruses, or other harmful software.
• Attempt to probe, scan, or test the vulnerability of the App's infrastructure without prior written authorisation.

Violation of these rules may result in immediate suspension or termination of your account, as described in Section 12.

7. Subscriptions & Payments

7.1 Premium Subscriptions

Bunkalist offers optional premium subscriptions that unlock additional features. Subscriptions are managed through RevenueCat and billed through Apple App Store or Google Play Store, depending on your device.

7.2 Pricing & Billing

Subscription prices are displayed in the App at the time of purchase and may vary by region. All pricing is set and managed by Apple or Google for their respective stores. We reserve the right to change subscription pricing at any time; price changes will take effect at your next renewal period after appropriate notice.

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You will be charged through your Apple or Google account.

7.3 Free Trials

Where offered, free trials automatically convert to a paid subscription at the end of the trial period unless cancelled before the trial ends. You will not be charged during the trial period.

7.4 Cancellation

You may cancel your subscription at any time through the App Store or Google Play subscription management settings on your device. Cancellation takes effect at the end of the current billing period; you will retain access to premium features until then.

7.5 Refunds

All payments are processed by Apple or Google. Refund requests must be directed to them via their respective support channels. We have no direct control over the refund process.

7.6 Lifetime Purchases

Where a one-time "Lifetime" purchase is offered, it grants access to premium features for as long as the App exists and is maintained. As this is a personal project, we cannot guarantee the indefinite continuation of the service. If the App is discontinued, no refund will be automatically issued; you should contact us at bunkalist@gmail.com to discuss the situation.

8. Third-Party Services & Content

8.1 TMDB Content

Content metadata displayed in the App (titles, posters, synopses, cast, ratings, etc.) is sourced from The Movie Database (TMDB) API. Bunkalist is not affiliated with, endorsed by, or certified by TMDB. Accuracy and completeness of metadata are not guaranteed.

8.2 Third-Party Links

The App or this website may contain links to third-party websites or services (e.g., streaming platform links via JustWatch data). We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

8.3 App Store Terms

Your use of the App is also subject to the terms and conditions of the Apple App Store or Google Play Store from which you downloaded the App. In the event of any conflict between these Terms and the App Store terms, the App Store terms prevail with respect to the App Store's role.

8.4 Apple-Specific Terms

If you downloaded the App from the Apple App Store, you acknowledge that:

• These Terms are concluded between you and Naim Dridi Podadera only, and not with Apple Inc.
• Apple has no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App.
• Apple is a third-party beneficiary of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.

9. Intellectual Property

9.1 Our IP

The Bunkalist name, logo, app design, interface, original code, and all related materials are the intellectual property of Naim Dridi Podadera. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of our intellectual property without prior written permission.

9.2 TMDB Attribution

All content metadata (titles, posters, descriptions, cast, ratings) is provided by The Movie Database (TMDB) and remains the property of its respective owners and TMDB. Use of TMDB data is governed by the TMDB Terms of Use.

9.3 Feedback

If you submit feedback, suggestions, or ideas about the App (e.g., feature requests via support channels), you grant us a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose, including improving the App, without any obligation to compensate you.

10. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

• We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
• We do not warrant the accuracy, completeness, or reliability of any content metadata sourced from TMDB or any other third party.
• We do not warrant that the App will be available at any specific time or location.
• We are not responsible for any content on third-party services linked from the App.
• As this is a personal project operated by an individual developer, the App may be subject to downtime, bugs, or service interruptions that a commercial service would be expected to avoid.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Naim Dridi Podadera shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, watchlists, or user content.
• Loss of profits or revenue.
• Loss of access to premium features due to service interruption or discontinuation.
• Any damages resulting from your use of, or inability to use, the App.
• Any unauthorised access to or alteration of your data.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or €50 (EUR fifty), whichever is greater.

12. Termination

12.1 Termination by You

You may stop using the App at any time. You may also delete your account via Settings → Account → Delete Account. Deleting your account terminates your agreement with us for the ongoing use of the App (other than provisions that survive termination, as noted below).

12.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App, with or without notice, if:

• You violate any provision of these Terms.
• Your use of the App poses a risk to the security or integrity of our systems or other users.
• We are required to do so by law or a court order.
• We decide to discontinue the App.

12.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall do so, including but not limited to: Sections 5.2 (Licence to Us), 9 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), and 13 (Governing Law).

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App will be resolved through good-faith negotiation. If we cannot resolve a dispute informally, the dispute shall be subject to the exclusive jurisdiction of the courts of Spain, unless applicable consumer protection laws in your jurisdiction provide otherwise.

EU/EEA users: If you are a consumer resident in the EU or EEA, you may also contact the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr. Our contact for ODR purposes is bunkalist@gmail.com.

Nothing in these Terms shall affect your rights as a consumer under the mandatory consumer protection laws of the country in which you reside.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, applicable laws, or our practices. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Notify you via an in-app message where reasonably practicable.

Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
